Your use of the services available on or through the Website www.productofgod.net (the “Website”) are subject to the following terms and conditions. You must read all of the terms and conditions set out below and if you do not agree to be bound by these terms and conditions you should not use or access the services on this Website. Your continued use of the Services on this Website will constitute acceptance of these terms and conditions.
We may amend these terms and conditions at any time by posting the amended terms and conditions on the Website. Such terms and conditions as varied will apply to all transactions after posting. These terms and conditions are effective as at 12th May 2007.
Unless otherwise indicated in the item's description, each Print edition features our distinctive embossed authentification stamp and is signed and numbered by the Artist, or is supplied with an authentification certificate signed and numbered by the Artist. We have gone to great lengths to ensure you receive your artwork in perfect condition and, unless otherwise indicated, they are delivered unframed in a range of sizes which fit most retail outlet standard frames. Some editions are delicate, and it is strongly recommended that excessive handling of the edition is avoided and framing is arranged soon after delivery. As with all artworks, it is best to avoid hanging above sources of direct heat, direct sunlight or in damp and humid environments.
Many of our editions are Giclee prints produced digitally using the most up to date technology available. Each edition is produced under the close supervision of the Artist to ensure a faithful representation of the original image.
There may be slight colour differences between items as viewed on the site and the actual print colours, which are caused by the variations in computer screen quality representation of our items.
ProductOfGod does not accept responsibility for such discrepancies.
1. ORDERING AND PAYMENT:
1.1 ProductOfGod only accepts payment by the following credit or debit cards (Visa, Visa Debit, Electron, MasterCard, Solo and Maestro/Switch).
1.2 All payments must be in £UK Pounds Sterling. The exchange rate that will apply is determined by your card issuer. Please contact your card issuer for further information on the applicable rates of exchange. You agree that we may issue you with invoices in electronic form by email.
1.3 All currency prices shown on our site, except £UK Pounds Sterling, are approximate indications only and should be used as a guideline only. You will be charged at your credit/debit card company’s rate, which may differ. To view current exchange rates please contact your credit/debit card company.
1.4 ProductOfGod is a trading name of Big Photographic Limited and all payments must be made to Big Photographic Limited and will be shown as such on your invoice. All payments are handled securely by WorldPay (Internet Service Payment Providers). You agree to accept the terms and conditions imposed by Worldpay for which please see www.worldpay.com. Payment will be debited from your card before the dispatch of the goods you have purchased. Upon processing a transaction, WorldPay will email you an electronic transaction receipt which will be sent to the email address you provide. ProductOfGod will then also send you an email confirming your order and that the payment has been received by us. Please keep both of these emails for your records.
ProductOfGod does not hold your credit or debit card details as all card data is processed securely by WorldPay.
When entering your card details please make sure your information is correct. The invoice address must be the address where the card is registered. This is a security feature put in place by the card companies to make online shopping safer for both the customer and the retailer.
1.5 Price and availability are subject to change without notice.
Delivery costs will vary depending on where you are in the world and the size and weight of your item. Delivery costs are shown in the Shopping Cart area.
The costs are split into 4 main regions:
UK, Europe (both EU and non-EU together), USA & Canada, and Rest of the World (including Japan, Australia etc).
1.6 We will begin supplying the goods you have ordered to you once you have placed an order and we have received payment in cleared funds. You will have the right to cancel any order under the Consumer Protection (Distance Selling) Regulations 2000 or any equivalent legislation in your jurisdiction for any reason provided that you do so within seven working days after the day on which you receive the goods. Notice of cancellation must be in writing and must be sent to us by email to sales@productofgod.net or by post or fax to the address set out above.
1.7 We use all reasonable endeavours to ensure that our website does not have any problems and that the goods displayed are available. However we cannot guarantee the availability of the website or that any goods on the site are in stock or available.
In the case of an ordered item becoming out of stock, items will be allocated on a time-ordered basis and a full refund offered to all excess orders.
1.8 In the event that an item is mistakenly listed at an incorrect price, we reserve the right to refuse or cancel any orders placed for such item listed at the incorrect price, whether or not the order has been confirmed and your card charged. If your card has already been charged for the purchase and your order is cancelled, we shall issue you a refund in the amount of the incorrect price.
2. DISPATCH AND DELIVERY:
2.1 PLEASE ALLOW UP TO 21 DAYS FOR DELIVERY. We will email you to notify you once your order has been dispatched. If we are unable to deliver your order within 21 days we will contact you to advise you of this. You will then have three options: to cancel the order and receive a full refund; to agree a substitution of the goods you ordered; or to accept a later delivery date.
2.2 We make every effort to ensure your purchase reaches you in perfect condition – prints are sent out in a tough protective cardboard tube. Delivery within the UK is done by Royal Mail Special Delivery. International Delivery is done by Fedex. So your order is in safe hands. If your order hasn't arrived don't hesitate to contact us. We can track & trace your package.
2.3 *IMPORTANT – CUSTOMS & DUTY*
Please note that all shipments to OUTSIDE the EU (European Union) may be subject to import duties and taxes, which are levied once a shipment reaches that country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. If your order does incur import duties and taxes by your local customs authority in your country, then these will need to be paid direct by you to them/the courier before they will release your shipment to you. Customs policies vary widely from country to country, so you may want to contact your local customs office for further information. You agree to indemnify us in full in respect of any such duties and taxes.
3. RETURNS AND REFUNDS POLICY:
3.1 In the event that any items are lost or damaged in transit, please contact us immediately via email at sales@productofgod.net or by telephone on +44 (0)207 739 5601.
3.2 In the case of items received damaged or faulty please retain the items and contact us within 24 hours of receipt. We may ask you to return the damaged or faulty goods to us straight away. Upon receipt of the goods by us if they are damaged or faulty they will be either exchanged or we will provide a refund of the cost of the items. In either case we will reimburse you the cost of returning the faulty or damaged goods and we will pay the cost of delivering any replacement item to you.
In all other cases you have the right of cancellation referred to in clause 1.6 above. We will refund the monies to you (including delivery charges) as soon as possible but in any event within 30 days of receipt of your cancellation notice. If you do not send notice of cancellation within the required time limit a refund will thereafter only be given strictly at the discretion of ProductOfGod. Your statutory consumer rights are not affected.
Return postage is the responsibility of the customer but will be refunded if items are faulty. If you fail to return the goods following a valid cancellation of your contract with us then we have the right to deduct the cost of us recovering the item(s) from you out of any refund that may be due to you.
Refunds will be made by crediting the credit or debit card that you used for the original order.
You are required to keep the item(s) in good condition. All returned items must be in a good saleable condition so should be covered by some form of postal/delivery insurance. ProductOfGod accepts no responsibility for returned items lost or damaged in transit to us.
4. COPYRIGHT:
4.1 The content available through the Website is the sole property of ProductOfGod or its clients and contributors and is protected by patent, copyright, trade and other intellectual property laws. Images used in this Website are reproduced with the express permission of the relevant Artist.
Copyright is retained by the Artists and must not be reproduced without the express written permission of the Artist or ProductOfGod. The Copyright on this Website is owned by ProductOfGod©2006-2007. Any unauthorised reproduction is an infringement of our rights and may result in legal proceedings.
5. PRIVACY NOTICE:
5.1 Personal data received during the order process is used solely for the purpose of processing and delivering your order.
Your information will not be passed onto any other third parties.

6. ADDITIONAL TERMS & CONDITIONS OF USE:
6.1 The user may access any part of the site to view for personal non-commercial use only. Copying, distributing or any use of the materials contained on the Website for any commercial purpose is prohibited.
6.2 The content of the Website is for general information only and does not constitute any form of advice or recommendation upon which a specific decision should be made. ProductOfGod has done its best to ensure the accuracy and currency of the materials contained on its Website but excludes any warranty express or implied as to quality, accuracy, timeliness, completeness or fitness for a particular purpose of the material contained in this Website. ProductOfGod will not be liable for any claims, penalties, loss, damages or expenses arising from the use or the inability to use the Website or from any unauthorised access or alteration to the Website (any a third party). Whilst we take reasonable steps to protect our systems from electronic virus attack or other harmful event we give no warranty that the Website is free of any virus or other harmful matter.

ProductOfGod accepts no responsibility for the content of these Websites and specifically excludes all liability that may arise with respect to or as a result of such material causing damage, costs, injury or financial loss of any kind.

7. LIMITATION OF LIABILITY
7.1 No Warranty
We (and our parent, subsidiaries, affiliates, officers, directors, agents and employees) do not guarantee continuous, uninterrupted or secure access to our services, and operation of the Site may be interfered with by numerous factors outside of our control. Nothing in this User Agreement shall limit or exclude our liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence or the negligence of our, agents or employees. Subject to the foregoing, we (including our parent, subsidiaries, affiliates, officers, directors, agents and employees) will not be liable for any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, or any special, indirect of consequential damages (however arising, including negligence) arising out of or in connection with this agreement or your use of the website. Some jurisdictions do not allow the exclusion of incidental or consequential damages, so the above exclusion may not apply to you.
We (including our parent, subsidiaries, affiliates, officers, directors, agents and employees) also have no liability of any sort (including liability for negligence) for the acts or omissions of other providers of telecommunications services or for faults in or failures of their networks and equipment.
Our liability to you or any third party, and the liability of our parent, subsidiaries, affiliates, officers, directors, agents and employees, in any circumstance is limited to the greater of (a) the total sum you have paid to us in relation to the goods ordered by you giving rise to liability, and (b) £100.
7.3 Indemnity
You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of this User Agreement (including the documents incorporated by reference) or your violation of any law or the rights of a third party.
7.4 Notices
Unless otherwise explicitly stated, notices to us must be sent by registered mail to Big Photographic Limited t/a ProductOfGod, Unit 6.01 The Tea Building, 56 Shoreditch High Street, London E1 6JJ, United Kingdom, and notices to you will be sent to the email address that you provide to us during the ordering process (receipt is deemed 24 hours after an email is sent, unless we receive notice that the email address is invalid), or by registered mail.
8. APPLICABLE LAW, JURISDICTION AND MISCELLANEOUS:
8.1 These Terms & Conditions of use shall be construed and interpreted in accordance with English Law. The courts of England and Wales shall have exclusive jurisdiction in relation to any claim, dispute or other matters arising therefrom. For the exclusive benefit of ProductOfGod, it shall retain the right to bring proceedings in the courts of the country of residence of any user of the Website.
8.2 If any provision of these Terms & Conditions is found to be invalid by any Court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms & Conditions which shall continue to have full force and effect.
8.3 These terms are not intended to confer any benefit on a third party under the provision of the Contracts (Rights of Third Parties) Act 1999.
8.4 The failure of ProductOfGod to exercise any right or remedy under these Terms & Conditions shall not constitute a waiver of that right or remedy.
